BILLS OF SALE - JUDGES' ORDERS' - WARRANTS OF ATTORNEY, AND COGNOVITS

NOTE. - By the Bills of Sale Amendment Act (29 & 30 Vict., cap. 96) all Bills of Sale must be re-registered every period of five years, and if not so re-registered the original registration ceases to be of any effect. Parties interested in such re-registration must ascertain through the secretary if the same has been done pursuant to the Act.
> Subscribers are reminded that the following lists are intended to induce caution and inquiry before credit is given, but not that it should be assumed therefrom that the cases reported affect the commercial credit or responsibility of the parties.
B. S. signifies Bill of Sale. - Absolute assignments, and conveyance on sale or gift of personal property, require to be registered as Bills of Sale, as well as mere securities or mortgages, and do not therefore affect the commercial credit of the giver.
J. O. signifies Judge’s Order. - A Judge’s Order is a simple form of staying an action by consent of the parties. It is often used in the settlement of properly disputed actions, when terms of arrangement have been arrived at, and where the creditor even agrees to accept in settlement a sum the debtor may have offered to pay before action brought, and it is sometimes unnecessarily registered after the amount is paid; but the register affords no means of distinguishing such cases.
W. A. signifies Warrant of Attorney; Cog., Cognovit. - These instruments are given in acknowledgment of the evidence of a debt, fix the mode of payment, and empower the creditor to issue execution on default.
