John Whyte appeared by his attorney for a fourth day against Whetell6 late of Peryeven in the county aforesaid marchaunt, John Rychard late of Peryeven in the county aforesaid chaplain, William Helyar late of Peryeven in the county aforesaid maryner, Walter Plukke late [of] Peryeven in the county aforesaid husbondman, Nicholas Brewer late of Fowey in the county aforesaid grome and John Thomas late of Earyhey in the county aforesaid yoman, in a plea wherefore by force of arms they broke into the house of the said John Whyte at Poytpygham, and made assault on Blanche his wife and Cecilia Bowdon and Margaret Whyte his servants there, and beat, wounded and ill-treated them, so that their lives were despaired of, whereby the same John Whyte lost the service of his servants aforesaid for a long time, and other enormities &c. to grave damage &c. and against the peace &c.; and (the defendants) have not come; and it had been ordered the sheriff to attach them &c.; and the sheriff now reports that they have nothing (in his bailiwick in lands or chattels whereby they might be attached) &c.; therefore let them be taken, to be here on the quindene of Easter &c.
