Whereas by an ordr of the 3d of this month It was ordered that a former ordr of the 29th of May last should be discharged vnles the plt should shew cause to the contrary Vpon opennge of the matter this p’nte day vnto the Rt Honoble ye Lo Comrs. &c’. by Mr Rich beinge of the plt’s. Co: in the p’nce of Mr Sandford beinge of the def’ts co: & vpon readinge of a formr ordr. of the 29th of June 13o Car’ Rs1 taken vpon the hearinge of the cause It was alleadged that by the said order the s’d pl’t was to pay vnto the def’t the rent arreare & due vnto him deductinge the pfitts rec’d by the def’t since his reentry to be computed by Mr Page one &c’ And vpon paymt of the money reported the def’t was to make a lease of the prmiss’s to the plt wch money the said Mr cast vp to amounte to 12li’ 10s’ & the said pl’t did accordingly tender the s’d money wch the def’t rec’d Yet neurtheles the deft. would auoyde the makinge of the s’d lease but yt was now alleadged by the def’ts Co: that it was a whole yeere after the s’d money should haue been p’d that the s’d pl’t tendred the sa’me & the same was not rec’d And now the def’t hath lett the prmisses to another It is thought fitt and so ordered that That2 the Mr shall consider hereof & see whether the s’d money be paid or any pte thereof, And what shall appeare to be vnpaid the said pl’t shall pay the same vnto the s’d def’t by Mich’as next the said def’t deducting & allowenge vnto the pl’t for the pfitts of the prmisses rec’d by the +def’t+ & vpon paymt. by the pl’t of the s’d money the s’d def’t is to make a new Lease vnto the pl’t accordinge to the ordr on hearinge
