1911 : James John Pluckrose - comments on his Trial

Title: The Justice of the Peace, lxxv 497
Date: 21 October 1911

Grand Jury  — Functions of a Murder Charge

On the 13th inst. on the trial of James John Pluckrose, 59, moulder, who pleaded “Guilty” to the manslaughter of his wife.

It appeared that the Grand Jury threw out the bill for murder, and also that they threw out the bill for murder in three other cases, upon which Mr. Justice Scrutton observed I can only say that I think such a course is extremely to be regretted. The prisoner has to come for trial anyhow, and it is very unfortunate that the Grand Jury, without any direction in law from the Judge as to the difference between murder and manslaughter (an obscure subject which even some of us do not completely understand), should take upon themselves to settle what crime a prisoner is to be tried for.
